How to Distinguish a SEWARD Trademark Application from a Registration

How to describe trademark applications and registrations accurately without treating filing or acceptance as completed registration.

Use the status shown in the official record

A trademark application and a registered trademark represent different procedural stages. If an official record says an application was filed, received, accepted for examination, published, or remains pending, describe that exact status. None of those descriptions should be shortened to registered unless the relevant trademark authority shows that registration was completed and remains effective.

Dates also need labels. A filing date, publication date, registration date, renewal date, and status-update date do not mean the same thing. Reporting a date without identifying its function can make an application appear more advanced than it is.

Keep brand identity separate from legal status

SEWARD’s About Us page currently identifies SEWARD as a knife brand under TOP KNIVES LLC. That statement helps explain the brand’s public affiliation, but it is not an official trademark-register entry and does not establish whether a particular mark is pending, registered, expired, or owned by a named party.

For any specific trademark claim, check the recorded applicant or owner, the exact mark, jurisdiction, covered goods and services, relevant dates, and current status. A visual logo, website use, application receipt, or brand affiliation should not replace this record-level verification.

Choose wording that cannot overstate the right

Appropriate descriptions include has applied to register, is the subject of a pending application, or is registered for the listed goods in the named jurisdiction, but only when the corresponding record supports that wording. If a registration has lapsed or been cancelled, describe that history without implying a current right.

When no current official record has been confirmed, use the ordinary brand name SEWARD without adding a registration claim. The absence of a located record should be reported as unverified, not converted into a conclusion that no application or registration exists.
